Agreement to Terms

By accessing or using Holy Fact Quest (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP.

1. Acceptance of Terms

1.1 Binding Agreement

These Terms constitute a legally binding agreement between you ("User," "you," or "your") and WHIGGEO LLC ("we," "us," or "our"), the developer and operator of Holy Fact Quest.

1.2 Age Requirements

• You must be at least 13 years old to use the App
• An age verification screen is presented on first launch
• Users under 18 should have parental/guardian awareness of their App usage
• Parents/guardians are responsible for minors' use of the App

1.3 Modifications

• We reserve the right to modify these Terms at any time
• Changes will be effective upon posting in the App
• Continued use after changes constitutes acceptance
• Material changes will be communicated via in-app notification

2. Description of Service

2.1 The App

Holy Fact Quest is a Bible trivia and educational game application that offers:

• Multiple challenge types and game modes (Bible Books, Timeline, Character Connection, Scripture Memory, Biblical Languages, Advanced Challenges)
• Five Challenge Journey Mode with Divine Gauntlet boss battle
• AI-powered Study Hall (using OpenAI GPT-4) for exploring Biblical topics
• Progress tracking, adaptive difficulty, and achievements
• Global and weekly leaderboards
• 55+ badges across 4 tiers
• Voice narration powered by ElevenLabs

2.2 Availability

• The App is provided "as is" and "as available"
• We do not guarantee uninterrupted or error-free service
• Features may be added, modified, or removed at our discretion
• Service may be temporarily unavailable for maintenance

2.3 Updates

• We may release updates to improve the App
• Updates may be required for continued use
• You are responsible for maintaining a compatible device

3. User Accounts

3.1 Player Profile

• When you first use the App, you choose a display name
• No email, password, or personal information is required
• Your display name appears on public leaderboards
• Display names are subject to our content filter (profanity and inappropriate names are not allowed)

3.2 Account Security

• Your player profile is tied to your device
• You are responsible for maintaining access to your device
• We are not liable for losses due to unauthorized device access

3.3 Account Termination

• You may delete your data at any time from the App's Settings screen
• We may suspend or terminate accounts that violate these Terms
• Upon termination, your access to the App and its features will cease

4. User Conduct and Restrictions

4.1 Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

4.2 Prohibited Activities

You may NOT:

• Violate any laws or regulations
• Infringe intellectual property rights
• Upload malicious code or viruses
• Attempt to hack, reverse engineer, or disrupt the App
• Use automated tools (bots, scrapers) to interact with the App
• Impersonate others or create misleading display names
• Submit inappropriate, offensive, or harmful content to the AI Study Hall
• Exploit bugs or glitches for unfair advantage on leaderboards
• Reverse engineer, decompile, or extract source code from the App
• Remove copyright or proprietary notices
• Use the App for commercial purposes without written permission
• Create derivative works based on the App

4.3 Content Moderation

• We apply automated content filtering (including profanity detection) to display names and AI Study Hall inputs
• We reserve the right to remove content or reset display names that violate these Terms
• We may flag or review suspicious leaderboard scores
• Repeated violations may result in account suspension

5. Intellectual Property Rights

5.1 Ownership

• The App and all content (text, graphics, audio, code, game design) are owned by WHIGGEO LLC or our licensors
• All trademarks, logos, and service marks (including "Holy Fact Quest" and the app logo) are our property
• Biblical source content is public domain or used under appropriate license
• AI-generated Study Hall responses are provided for your personal educational use

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install the App on your personal device
• Use the App for personal, non-commercial, educational purposes

5.3 Restrictions

You may NOT:

• Copy, modify, or distribute the App
• Sell, rent, lease, or sublicense the App
• Use the App to create competing products
• Extract source code, algorithms, or game data

6. AI-Generated Content

6.1 AI Study Hall

• The App includes an AI Study Hall feature powered by OpenAI's GPT-4
• This feature generates answers to Bible-related questions you submit
• Voice narration of answers is generated using ElevenLabs text-to-speech technology

6.2 Disclaimer

• AI-generated content is for educational and informational purposes only
• AI responses may contain errors, inaccuracies, or incomplete information
• Always verify AI-generated answers against Scripture and trusted Biblical scholarship
• The App is not a substitute for formal religious education, pastoral counsel, or theological authority
• We do not guarantee the theological accuracy or completeness of any AI-generated response
• We are not responsible for decisions made based on AI-generated content

6.3 Content Moderation

• We apply content moderation to AI Study Hall inputs and outputs
• Questions that are inappropriate, offensive, or unrelated to Biblical topics may be filtered
• We reserve the right to limit or restrict access to the AI Study Hall feature

7. In-App Purchases and Subscriptions

7.1 Premium Features

• The App offers optional in-app purchases and subscriptions
• Core gameplay is always available for free
• Prices are listed in your local currency within the App
• Payment is processed by Apple App Store or Google Play Store

7.2 Subscriptions

• Subscriptions auto-renew unless canceled at least 24 hours before the renewal date
• You can manage and cancel subscriptions through your Apple or Google account settings
• Refunds are subject to Apple/Google refund policies
• Subscription features and pricing may change with notice

7.3 Consumable Purchases

• Some purchases are for consumable items (e.g., streak shields, AI question packs)
• Consumable items are used within the App and have no real-world monetary value
• Consumable items are non-transferable

7.4 Refund Policy

• All purchases are processed by Apple App Store or Google Play Store
• Refund requests must be directed to Apple or Google
• We do not directly control refund decisions

7.5 Price Changes

• We reserve the right to change prices with reasonable notice
• Price changes do not affect active subscription periods
• You will be notified of price changes before your next renewal

8. Third-Party Services

8.1 Services We Use

The App relies on the following third-party services:

• PlayFab (Microsoft): Player identity and leaderboard services
• OpenAI: AI-powered Study Hall responses
• ElevenLabs: Voice narration and audio generation
• Google AdMob: In-app advertising
• Apple App Store / Google Play Store: App distribution, purchases, and subscriptions

8.2 Third-Party Terms

• Each third-party service operates under its own terms and privacy policy
• We are not responsible for third-party service availability, content, or practices
• Your use of the App constitutes acceptance of applicable third-party terms

9. Privacy and Data

9.1 Privacy Policy

Your use of the App is also governed by our Privacy Policy, available at:

By using the App, you consent to data collection as described in the Privacy Policy.

9.2 Data Deletion

• You can delete all your data from the App's Settings screen

10. Disclaimers and Warranties

10.1 "AS IS" Disclaimer

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of content

10.2 No Guarantee

• We do not guarantee the App will be error-free or uninterrupted
• We do not warrant that defects will be corrected
• We do not guarantee specific results from using the App

10.3 Content Accuracy

• Biblical content is for educational and entertainment purposes
• While we strive for accuracy, we do not guarantee theological perfection
• AI-generated content may contain errors (see Section 6)
• The App is not a substitute for formal religious education
• Consult religious authorities for authoritative theological interpretations

11. Limitation of Liability

11.1 No Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHIGGEO LLC SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Lost profits, data, or opportunities
• Damages resulting from use or inability to use the App
• Unauthorized access to your data
• Errors or omissions in content (including AI-generated content)
• Third-party actions or content

11.2 Maximum Liability

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is less.

11.3 Exceptions

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless WHIGGEO LLC, its officers, directors, employees, and agents from:

• Claims arising from your use of the App
• Violations of these Terms
• Infringement of third-party rights
• Content you submit (including AI Study Hall questions)
• Negligent or wrongful conduct

13. Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of Illinois, United States, without regard to conflict of law principles.

13.2 Informal Resolution

Before filing any claim, you agree to contact us at support@holyfactquest.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve any dispute within 30 days.

13.3 Jurisdiction

If informal resolution fails, any legal action shall be brought in the state or federal courts located in Cook County, Illinois.

13.4 Class Action Waiver

To the extent permitted by law, you agree that any disputes will be resolved on an individual basis and not as part of a class action.

14. Termination

14.1 By You

• You may stop using the App at any time
• Delete your data from the App's Settings screen
• Uninstall the App from your device

14.2 By Us

We may suspend or terminate your access if:

• You violate these Terms
• Your account shows suspicious activity (e.g., leaderboard manipulation)
• Required by law
• We discontinue the App

14.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• We may delete your account data
• Provisions that should survive (liability, indemnification, IP rights) remain in effect
• You remain liable for any charges incurred before termination

15. Miscellaneous

15.1 Entire Agreement

These Terms, along with the Privacy Policy, constitute the entire agreement between you and WHIGGEO LLC regarding the App.

15.2 Severability

If any provision is found invalid, the remaining provisions remain in effect.

15.3 No Waiver

Failure to enforce any right or provision does not constitute a waiver.

15.4 Assignment

• You may not assign these Terms without our written consent
• We may assign these Terms without restriction

15.5 Force Majeure

We are not liable for delays or failures due to circumstances beyond our control (natural disasters, wars, pandemics, internet outages, third-party service failures, etc.).

15.6 Electronic Communications

You consent to receive electronic communications from us (in-app notifications, push notifications), which satisfy legal requirements for written notice.

16. App Store Terms

16.1 Apple App Store

If you download the App from the Apple App Store:

• These Terms are between you and WHIGGEO LLC, not Apple
• Apple has no obligation to provide maintenance or support for the App
• Apple is not liable for the App or its content
• You must comply with Apple's Usage Rules in the App Store Terms of Service
• Apple is a third-party beneficiary of these Terms

16.2 Google Play Store

If you download the App from Google Play Store:

• These Terms are between you and WHIGGEO LLC, not Google
• Google has no obligation to provide maintenance or support for the App
• Google is not liable for the App or its content
• You must comply with Google Play Terms of Service

18. Special Provisions

18.1 California Residents

18.2 EU Residents

EU users have additional rights under GDPR as described in our Privacy Policy.

19. Acknowledgment

BY USING HOLY FACT QUEST, YOU ACKNOWLEDGE THAT:

• You have read and understood these Terms
• You agree to be bound by these Terms
• You are at least 13 years old
• You understand the App is for educational and entertainment purposes
• You understand AI-generated content may contain errors and should be verified with Scripture
• You agree to use the App responsibly and lawfully
